John Hocknell 1673

In the name of god Amen: I John Hocknell of Castlethrupp in the countie of Bucks: yeoman, beinge sicke in bodie, but of perfect memorie, thanks be given to god for the same, doe make my last will and testament in manner and forme followinge; ffirst I bequeath my soule unto allmightie god whoe created it, to Jesus Christe whoe redeemed it, and to the holie ghost whoe sanctified and preserved me, three persons and one god, whom I doe adore, and will acknowledge for ever; and my bodie to the earth from whence it came; Itm I doe give and bequeath unto my sister Anne Tindall five pounds to be paide unto her within twoe yeares after my decease; Itm I doe give and bequeath unto my sister Mary Hocknell, twelfe pounds and tenn shillings, to be paide unto her within two yeares after my decease; Itm I doe give and bequeath unto my cosenns Richard Hocknell and Willyam Hocknell thirtie nine pounds and tenn shillings, to be paide unto them within three yeares next after my decease, Nevertheless in trust and to the uses heareafter expressed; that is to said twelve pounds theareof, unto my brother George Hocknell to be paide unto him when he shall accomplish the age of twentie and one yeares; yf he shall then well behaved and Demeamed himselfe; and fifteene pounds thereof unto my brother Willyam Hocknell, to be paide unto him when he shall accomplishe the age of twentie one yeares; yf he shall then well behaved and Demeamed himselfe; and the other twelfe pounds and tenn shillings theareof unto my cosen Thomas mackernes, my sister Elizabeth mackernes her sonne, to be paide unto him when he shall accomplish the age of twentie and one yeares; yf he shall then likewise have well behaved and Demeaned himself; and if my saide brothers and cosen Thomas Mackernes, or any of them shall then either have lived disorderly or unruly and so continew wheareby it shall appeare to the saide Richard Horknell and Willyam Hocknell, that they shall not be worthie of the saide legacie or legacies soe given as aforesaide; then my will is that they the saide Richard Hocknell and Willyam Hocknell shall have power to detaine and keepe in theire handes the aforesaide legacies soe given to my saide brothers and cosen mackerness as aforesaide, and onely allowe unto them such benefit out of theire saide legacies as shall arise to be made theareof, and to paie them and every of them severallie and respertivelie theire saide legacies when att such time as they the saide Richard and Willyam Hocknell shall thinke fitt; provided allwaies and my will is, that if any of my saide brothers and sisters, and my saide cosen mackernes, or any of them shall die before theire saide legacies shall be paide unto them in manner and forme as before given and bequeathed; then my will is that the legacie or legacies of such of him, her or them that shall die shallbe paide unto the saide Richard and Willyam Hocknell and by them dystributed amongst the rest of my brothers and sisters and my saide cosenn mackernes, that shallbe then livinge, accordinge to the disretion of the saide Richard and Willyam Hocknell; Item I doe give and bequeath unto the saide, Richard and Willyam Hocknell, three pounds to be paide unto them within one month after my decease neverthelesse in trust, and to be by them ymploied and bestowed, towards the binedinge of my brother George Apprentise with them: he now liveth with; and if in case my saide brother George, shall not serve out his apprentishippe with his paide master, and his saide master shall have had received the saide three pounds accordinge to the agrement hearetofore by me made with him concerninge the same; then my will is that his saide master in such case shall repaie backe againe into the handes of the saide Richard and Willyam Hocknell, the aforesaide three pounds, to be paide by them unto my saide brother George as the legacie of twelve pounds soe given unto him as aforesaide is to be paide and not otherwise; provided allwaise and my will is, that if I shall in my lifetime have paide the saide three pounds, unto my saide brother George his master, and theare shallbe an aquittance of the same, and my saide brother George shall have served out his saide apprentishippe with his saide master that then the aforesaide bequest of the saide three pounds by me given as aforesaide, shall become voide any thinge hearein conteyned to the contrary notwithstanding; Itm I doe give unto the saide Richard Hocknell and Willyam Hocknell my bible, to be by them bestowed unto which of my saide brothers, they shall thinke fitt: All the rest of my goods, cattlells, and chattels whatsoever, my debts beinge paide, my bodie brought to the ground, and my legacies discharged, I doe give and bequeath unto Mary my wellbeloved wife, whom I doe make my sole executrix of this my last will and testament; and in case my saide wife shall renounce her executrixshipp of this my last will and testament, then my will is and I doe make and nominate my loveing uncle Mathew Draper, and my cosenn John Billing my executors of this my last will and testament; unto whom I doe heareby give all the rest of my goods, cattels and chattels, payinge and dischargeinge my debts and legacies aforesaide and unto my saide wife twentie shillings as her lagacie, and she theare upon to have no other benefit by this my last will and testament, Itm I doe nominate and appoint Robert Tryill and John Cooke to be overseers of this my last will and testament, unto whom I doe give six pence a peece for theire paines and I doe hearebie renounce and revoke all other and former wills by me made;
