John Rooker Rainbow 1845

This is the last Will and Testament of me John Rooker Rainbow of Castlethorpe in the County of Buckingham Carpenter I nominate and appoint my dear Wife Rebecca Rainbow sole Executrix of this my Will and I give and bequeath unto my said Wife Rebecca absolutely all my Monies Securities for money Book Debts Stock in Trade Household Goods and Furniture And all other my personal Estate and Effects whatsoever and wheresoever subject to the payment of All my Debts and Funeral and testamentary expenses (except the principal and Interest due and owing upon Mortgage of my real Estate which I expressly charge on such my real Estate in exoneration of my personal Estate) And I give and devise All and every my Messuages Lands Tenements hereditaments and real Estate whatsoever and wheresoever subject to the payment of the principal and interest monies due and owing upon Security of the same unto and to the use of Joseph Bull of Castlethorpe aforesaid Farmer and William Grimes of the same place Farmer their heirs and assigns Upon trust to permit and suffer my said Wife Rebecca to receive and take the Rents and profits of all my said real Estate for and during the term of her natural life she paying thereout all Interest which shall from time to time accrue and become due on the principal monies secured by Mortgage And from and immediately after her Decease Then Upon trust that they the said Joseph Bull and William Grimes or the Survivor of them or the heirs or assigns of such Survivor do and shall so soon as conveniently sell and dispose of All my real Estate hereinbefore devised to them in such manner and by such means as to them or him shall seem expedient for the best price or prices that can be reasonably obtained for the same and convey and assure such real Estate when sold to the Purchaser or Purchasers thereof absolutely or as he or they may direct Provided always and I do hereby declare that with the consent of my said Wife the power of or trust for Sale of my said real Estate shall and may be exercised either wholly or partially during her Lifetime And I declare that the receipt in writing of the Trustees or Trustee for the time being of my said real Estate shall be an effectual discharge to every purchaser thereof for the money in such receipt expressed to be received and exonerate such Purchaser from all liability to see the Application hereof And I direct that the said Trustees or Trustee for the time being shall stand possessed of and interested in the monies to ensue from the Sale of my said real Estate Upon the trusts following that is to say. Upon trust to pay and discharge thereout the expenses incidental to such Sale and the execution of the Trusts hereby created and all principal and interest monies which shall be owing on Security of such Estate and in case such Sale shall be made during the lifetime of my said Wife Upon trust to invest the net residue of such monies at Interest upon Security and to pay the annual Income thereof to my said Wife during her natural life And immediately upon her Decease Upon trust to pay and divide the Capital monies so invested or if she shall have died previously to such Sale the net monies arising from such Sale as and when the same shall be received unto and equally between al and every my Children share and share alike Provided always and I direct that if any Child shall die previous to such division tacking place under the Age of Twenty one years and without having been married the Share of such Child shall be devisable equally among my surviving Children Provided also and I further direct that if upon the decease of my said Wife any Child shall be under the Age of Twenty one years the share of such Child shall be placed out at Interest by my Trustees or Trustee for the time being who shall apply the annual Income thereof and the whole or any part of the Capital thereof towards the maintenance and advancement of any such Child during Minority And I declare that my Trustees shall be responsible only for the monies which they shall respectively receive and for their own acts deeds and defaults only And I authorise them to pay and retain out of the monies coming to their hands all expenses whatsoever relating to the Trusts hereby created And I give and devise all Estates vested in me upon trust or by way of Mortgage unto and to the use of the said Joseph Bull and William Grimes their heirs and assigns for ever Upon and subject to the Trusts and Equity of redemption affecting the same In testimony whereof I have hereunto set my hand and seal this second day of April 1844 John Rooker Rainbow (S.S)
