1796 Enclosure Map - Transcript

The following is a transcript of the first six and last two pages of manuscript (out of 26) attached to the Enclosure Map. The first 3 pages describe the process followed by the Commissioners, their meetings and the appointment of the Surveyors. Pages 4 to 6 define the public and private roads, bridle ways and footpaths. The communal Stone Pit is specified on Page 6. Pages 7 to 24 specify to whom each plot of land has been allotted. Page 25 details the Corn Rents to be paid in lieu of Tythes. The Commissioners' oaths are on Page 26.

and heir of [-----] Hosea of [-----] in the County of [-----] and Thomas Tandy of Sherington aforesaid Lace Dealer Send Greeting Whereas in and by an Act fof Parliament made and passed in the thirty sixth year of the Reign of his present Majesty King George the Third Entitled "An Act for dividing and inclosing the Open and Common Fields Meadows Lands Commons and Commonable Places in the Parish of Sherington in the County of Buckingham" It was and is enacted (amongst other things) that the said John Chamberlin John Davis and John Fellows should be and they were thereby appointed Commissioners for the valuing qualifying dividing setting out allotting and inclosing the said Open and Common Fields Meadows Lands Commons and Commonable Places and for other the purposes of the said Act and for only carrying the same into execution in such manner as is thereinafter directed and that it should and might be lawful for the said Commissioners or any two of them and they were thereby fully authorized and empowered to execute do and perform all and every or any act Matter and Thing by the said Act authorized to be done and performed And Whereas the said Commissioners did on the fourth day of May One thousand seven hundred and ninety six in pursuance of the directions of the said Act and in conformity thereto Duly cause Public Notice in Writing to be affixed on one of the Doors of the Parish Church of Sherington aforesaid of the time and place of their first Meeting which was thereby appointed to be and was accordingly held at the house of Richard Higgins commonally called or known by the name or sign of the Swan in Newport Pagnell aforesaid on the seventeenth day of the same May for executing the powers vested and reposed in them in and by the said Act and due notice hath also been given of every subsequent Meeting for the like purpose (Meetings by Adjournment only excepted) At which said first Meeting the said John Chamberlin and John Davis did in obedience to the said Act and before they acted as Commissioners of the execution of the powers given them thereby (except the powers of appointing and giving Notice of the first Meeting of the said Commissioners and of the administering of the Oath as an Oath to the effect therin prescribed to be taken by each commissioner Severally take and subscribe the Oath or an Oath to the effect of the Oath prescribed in and by the said Act for each Commissioner to take and which said Meeting the said John Chamberlin and John Davis did adjourn to the next day when the said John Fellowes duly qualified himself to act in the execution of the powers of the said Act by taking and subscribing the Oath or an Oath to the effect before mentioned and which Oath so taken and subscribed by each of the said Commissioners is hereinto annexed to the intent the same may be inrolled at the same time and place this present Award or Instrument is in and by the said Act directed to be inrolled And for the more just and regular division and distribution of the said Lands and Grounds and for the better ascertaining the same It was and is in and by the Act now in recital Enacted that a Survey or Admeasurement and also a fair plan shall be made of the said Open and Common Fields Meadows Lands Commons and Commonable Places so intended by the said Act to be divided and inclosed as aforesaid and also of all the Homesteads Gardens Orchards Home Closes and other ancient Inclosures which were situated in the Parish of Sherington aforesaid so soon as conveniently might be by such person or

Persons as should be employed for that purpose by the said Commissioners and such Survey or Admeasurement should be reduced into writing and the number of acres roods and perches belonging to each proprietor should be set forth and ascertained therein and the said survey or Admeasurement and Plan should be laid before the said Commissioners at some or one of their Meetings to be held in pursuance of the said Act and should be verified upon Oath by the said Surveyor or Surveyors who should have made the same which Oath the said Commissioners or any one of them was and were thereby authorized and required to administer And Whereas the said Commissioners have in pursuance of the directions of the said Act carefully viewed the said Open and Common Fields Meadows Lands Commons and Commonable Places Ley Pasture and Sweard Ground by the said Act directed to be divided and inclosed and have made a true and perfect valuation Quality and Appraisement of the same And the said Commissioners did appoint William Collison the Younger and Michael Russell both of Brackley in the County of Northampton Land Surveyors to survey measure and plan the Lands directed by the said Act to be divided and inclosed and to do all other business that might be required of them as Surveyors and on the Twenty nineth day of the same May did cause another Notice to be affixed on the door of the Parish Church of Sherington aforesaid purporting that they had appointed their next Meeting to be held at the Swan Inn in Newport Pagnell aforesaid on the thirteenth day of June then next by which Notice the said Commissioners did order and direct the several Proprietors interested in the said Fields and Lands intended by the said Act to be divided and inclosed to deliver in to them the said Commissioners a Claim in writing of their several and respective rights and Interests in the said Lands and Grounds intended by the said Act to be divided and inclosed as aforesaid distinguishing the tenures on which the same were held and whether in Settlement or not together with a request in writing on a separate Paper sealed up describing the situations in which they might wish to have their respective Allotments in lieu of such rights and interests And the said Commissioners did thereby give notice that no Claims would be received by them after such Meeting except for some special reason to be approved by the ten said Commissioners And Whereas the said Commissioners did meet on the said thirteenth day of June pursuant to the Notice by them given as aforesaid when they received claims and requests for situations of such of the proprietors who complied with their order of the last meeting and directed their Clerk to write to such of the Proprietors who had not delivered their Claims to request them to deliver the same to Mr Lucas at Newport Pagnell aforesaid and which said Claims and requests for situations so neglected to be delivered in to them the said Commissioners at their first Meeting were delivered in to them the said Commissioners at a subsequent meeting held pursuant to Notice for that purpose affixed on the door of the Parish Church of Sherington aforesaid on a special reason approved of by them the said Commissioners who ordered that a fair copy of such Claims with a Notice thereunto annexed should be affixed on one of the principal doors of the Parish Church of Sherington aforesaid on Sunday the twentyfourth day of July the next ensuing and that they had adjourned their said meeting to Tuesday the ninth day of August then next And whereas a true and perfect Admeasurement of the said Open and Common Fields Meadows Lands Commons and Commonable Places Ley Pasture and Sweard Ground by the said Act directed to be divided and inclosed as aforesaid hath by the order and under the direction of the said Commissioners been made and taken by the said William Collison and Michael Russell or one of them and such Survey and Admeasurement hath been reduced into writing and a Map or Plan thereof made and the said Open and Common Fields Meadows Lands Commons and Commonable Places Ley Pasture and Sweard Ground by such Survey and Admeasurement contain in the whole One thousand and three hundred and forty three acres and two perches which with Seventy acres and twenty two perches of Old Inclosure allotted in Exchange makes together One thousand four hundred and sixteen acres and twenty four perches being the whole quantity of Land allotted and have also caused a true and perfect Admeasurement of the quantity of all and every the Homesteads Gardens Orchards Home Closes Spinneys and other ancient Inclosures in Sherington aforesaid and ascertained the value thereto And such Surveys and Admeasurements have been laid before the said Commissioners and examined by them at their several Meetings held subsequent to the making thereof in pursuance of the said Act and have been verified upon Oath by the said William Collison Now know ye therefore by these Presents that the said John Chamberlin John Davis and John Fellowes the Commissioners aforesaid by virtue and in pursuance of the powers given to them in and by the said in part recited Act and in Conformity thereto and having upon full and proper Evidence Enquiry and Satisfaction heard and determined all disputes and differences laid before them which have arisen between the parties or any of them touching or concerning the rights and interests which they or any of them have or had in the said Lands and Grounds by the said Act directed to be divided and inclosed or touching the survey thereof and having carefully examined into and only considered the situation

And Convenience of every part and parcel thereof and every other matter and thing referred to them the said Commissioners by the said Act and in all respects fully pursued the directions thereto Have set out and appointed and awarded and by these presents Do set out and appoint the several Public Highways or Roads and Private ways or Roadways Footways hereinafter described as the same are already staked out (?Videlicet?) One Publick Carriage and Drift Road of the width of fortyfive feet beginning at the East End of the village of Sherington aforesaid and extending in a South West South and Westward direction along the ancient Tract thereof over Lands and Grounds by the said Act directed to be divided and inclosed until it enters the Parish of Lathbury at a bridge over the River Ouse called or known by the name of Sherington Bridge which said Road is part of the Turnpike Road leading from Sherington aforesaid towards Newport Pagnell aforesaid and called the Newport Pagnell Road One other Publick Carriage and Drift Road of the like width of forty five feet beginning at the North West End of Sherington aforesaid and extending in a North West direction along the ancient Tract therof over Lands and Grounds by the said Act directed to be divided and inclosed as aforesaid to an ancient Lane in the said Parish of Sherington called Emberton Lane and continuing along the said Lane till it enters the Parish of Emberton at the North End of the said Lane which said Road is part of the Turnpike Road leading from Sherington aforesaid towards Olney and called the Olney Road One other Publick Carriage and Drift Road of the width of forty feet branching out of the first described Road called the Newport Pagnell Road near the North West Corner of the Furlong behind the bridge and extending in an Eastward direction along the ancient Tract thereof over Lands and Grounds by the said Act directed to be divided and inclosed as aforesaid till it enters the Parish of Chichley near the South East Corner of an old Inclosure belonging to the said Charles Chester called Wood Close which said Road is part of the Road leading from Newport Pagnell aforesaid towards the Town of Bedford and called the Bedford Road One other Publick Carriage and Drift Road of the like width of forty feet beginning at the North East End of a Lane in the said Parish of Sherington called Calves End Lane and extending in nearly a South East direction along the ancient tract thereof over Lands and Grounds by the said Act directed to be divided and inclosed as aforesaid till it meets or adjoins the last described Road near the South West corner of the said old Inclosure belonging to the said Charles Chester called Wood Close which said Road is part of the Road leading from Sherington aforesaid towards Chichley and called the Chichley Road And one other Publick Carriage and drift Road of the like width of forty feet beginning at the North West End of a certain Lane in Sherington aforesaid called Winyards Lane and extending in nearly a North Westward direction along the ancient tract thereof over Lands and Grounds by the said Act directed to be divided and inclosed as aforesaid till it meets or adjoins the second described Road called the Olney Road near the North West corner of a piece of Land called the Shoulder of Mutton which said road is part of the Road leading from Sherington Church End towards Olney aforesaid and called the Church End Road All which said Roads so described the said Commissioners have caused to be fenced out on both sides and in pursuance of the directions of the said Act and have by writing under their hands appointed a Surveyor who is to cause the said Roads to be formed and put in good and sufficient repair and which said publick Roads the said Commissioners do hereby order and direct from and after the same shall have been so formed and duly certified to be in such good and sufficient repair agreeable to the directions of the said Act shall be maintained and kept in such manner as other publick Roads and Highways are by Law directed to be repaired And the said Commissioners do hereby further order and direct that all the Grass and Herbage growing arising out and ??ronowing?? in over and upon all and every or any of the said Publick Roads hereinafter described shall at all times be enjoyed and had and taken by the several proprietors owners or occupiers of the Allotments adjoining such Roads from the ditches or boundary fences of their respective allotments to the Middle or Center of such Roads as far as each of their respective Allotments extend And the said Commissioners do also set out and appoint the following Publick and Private horse carriage and Drift Roads and Footways (??videlicet??) One Publick Bridle and Foot way and private Carriage Road of the breadth of Twenty four feet beginning at the West End of a Lane in the said Village of Sherington called Water Lane and extending in nearly a westward direction into through and over an Allotment hereinafter awarded to John Woodward an Allotment hereinafter awarded to Thomas Battams for tithes to the first Allotment hereinafter awarded to the said John Clayton and after which to continue a publick Bridle and Footway of the breadth of twelve feet into through and over the said first Allotment hereinafter awarded to the said John Clayton and the Allotment hereinafter awarded to the said John Clayton in lieu of tithes to a Gate in the hedge dividing the parish of Sherington and Tyringham called the ??foure?? Gate which said Road shall be and remain as a publick Bridle and Footway for the use of the publick in General and as a Private carriage and drift Road for the use and benefit of the several Owners and Occupiers for the time being of the several Allotments through which the said Road extend pass or adjoin respectively One other Publick Bridle Road and Foot Way and private Carriage Road of the breadth of twenty feet beginning at the North East End of the said Lane called Calves End Lane {----Last few words at the bottom of the page are unreadable------}

Between the Allotment of William Brooks and Samuel Boddington called Branch Green Lane into through and over the Allotment hereinafter awarded to the said Sir John Buchanan Riddell the allottment hereinafter awarded to William Brooks in lieu of tithes to a Gate at the West Corner of a close called Wood Close belonging to the said Charles Chester which said Road shall be and remain as a Publick Bridle and Footway and a Private Carriage and Drift Road for the use and benefit of the several Owners and Proprietors of Old Inclosures and new Allotments through which the said Road doth extend pass over or lead unto respectively and for the use and benefit of the said William Praed Charles Chester Richard Higgins Dryden Smith for and in respect of their several old Inclosures and Woods to which it leads and all and every the Owners and Occupiers of the said Old Inclosures and new Allotments their Agents Servants or Workmen for the time being And as a Publick Bridle and Foot Road for the use of the Publick in general One private Carriage and Drift Road of the breadth of twenty feet beginning at the North End of the second described Road called the Olney Road and extending in a westward direction into and through and over qan Allotment hereinafter awarded to Jane Sutcliffe the second Allotment hereinafter awarded to the said Samuel Greatheed in lieu of Lands and Common Rights to the Allotments hereinafter awarded to the said William Praed which said Road shall be and remain as a private carriage and drift road for the use and benefit of the said William Praed and of the several Owners and Proprietors of the Allotments through which the said Road doth extend pass over or lead unto repectively One other private Carriage and Drift Road of the like width of Twenty feet beginning at the South West Corner of a Wood in the Parish of Emberton extending along part of the South side of the said wood about one hundred and forty five Acres to an Angle or Bend in the hedge where it enters the said wood being through and over the Allotment hereinafter awarded to the said Samuel Greatheed in lieu of residue of tithes which said Road shall be and remain as part of a private Carriage and drift Road from the same Olney Road for the use of and benefit of the Owners and Proprietors of the said Allotment and Wood their agents Servants and Workmen for the time being One other private Carriage and drift Road and Publick footway of the like breadth of Twenty feet beginning at the South East corner of a certain piece of Land called New Pasture and extending in a North East direction into through and over Allotments hereinafter awarded to William Brooks to Old Inclosures called Stockings belonging to the said Samuel Boddington and Thomas Battams respectively which said Road shall be and remain as a Private Carriage and drift Road for the use and benefit of the Owners and Occupiers of the several Allotments through which the said Road doth extend pass or lead unto respectively and for the use and benefit of the Owners and Occupiers of the said Old Inclosures and their Agents Servants or Workmen for the time being One other private Carriage and drift Road of the like breadth of Twenty feet beginning at the East End of the third described Road called the Bedford Road and extending in a South East direction into through and over Allotments hereinafter awarded to the said Samuel Greatheed for Land and Tithes he holds for the life of Thomas Rogers to Allotments hereinafter awarded to the said Charles Chester in lieu of Tithes which said Road shall be and remain as a private Carriage and Drift Road for the use and benefit of the several Owners and Occupiers of the several Allotments their Agents Servants and Workmen through which the said Road doth extend pass over or lead unto respectively One other private carriage and drift way of the like breadth of twenty feet branching out of the third described Road called the Bedford Road at the North West corner of the furlong behind the bridge and extending in a South Eastward direction into through and over the second Allotmemnt hereinafter awarded to the said Company of Mercers to a certain Close of Old Inclosed Land called Marriotts Close belonging to Cropp Esquire which said Road shall be and remain for the use and benefit of the Owners and Occupiers of the said Allotment and Old Inclosure through which the said Road doth extend pass over or lead unto One other private carriage and drift Road of the like breadth of Twenty feet branching out of the second described Road called the Newport Road near the North East Corner of the Furlong shooting to the Mortar Pitts and extending in a westward direction into through and over the second Allotment hereinafter awarded to the said Samuel Greatheed and Ann his wife for Land devised by the will of the said John Hamilton the Allotment hereinafter awarded for public Stone Pitts or Quarries to the Allotment to the said John Walker which said Road shall be and remain as a private Carriage and drift Road for the use and benefit of the Owners and Occupiers of the several Allotments through which the said Road doth extend pass over or lead unto respectively and for the use and benefit of all persons having occasion to or from the said publick Stone Pitts or Quarries and all and every their Agents Servants or Workmen for the time being One other private carriage and drift road of the like breadth of twenty feet beginning on the first described Road called the Newport Pagnell Road near the Toll House and extending in a South East direction into through and over the Allotment to Thomas Odell for Land to Old Inclosures belonging to the said William Praed

Thomas Platt and the said John Buchanan Riddell respectively which said Road shall be and remain for the use and benefit of the Owners and Occupiers of the said Allotments and Old Inclosures their Agents Servants ans Workmen for the time being And one other private Carriage and Drift Road of the breadth of twentyfive feet beginning near the North West Corner of Townsend Furlong and extending in a South East direction into through and over the first Allotment hereinafter awarded to said Company of Mercers the first Allotment to the said Dryden Smith and to the Second Allotment hereinafter awarded to Thomas Battams for Lands and Common Rights which said Road shall be and remain for the use and benefit of the Owners and Occupiers of the several Allotments and Old Inclosures through which the said Road doth extend pass over or lead unto or adjoin respectively One public Foot way of the breadth of four feet beginning at a homestead in the said village of Sherington called Hardings Homestead and extending in a Southward direction into through and over the first Allotment hereinafter awarded to the said Thomas Battams for Lands and Common Rights the second Allotment hereinafter awarded to the said Samuel Greatheed and Ann his wife for land devised by the will of the said John Hamilton the Allotment hereinafter awarded to the said Thomas Odell in lieu of tithes till it meets or adjoins the said first described Road called the Newport Pagnell Road being part of the Footway leading from the said village of Sherington aforesaid towards Newport Pagnell aforesaid And one other Publick Footway of the like breadth of four feet branching out of the said second described Road called the Olney Road near the North East corner of Townsend Close and extending in a North Westward direction into through and over an Allotment hereinafter awarded to Thomas Meacher an Allotment hereinafter awarded to William Davison the third Allotment hereinafter awarded to Samuel Boddington the second Allotment hereinafter awarded to the said Charles Chester for Land and Common Rights and the second Allotment hereinafter awarded to the said Samuel Greatheed for freehold Lands and Common Rights to a Stile in the fence dividing the parishes of Sherington and Tyringham which said Road is part of the Foot Road leading fom the said village of Sherington aforesaid towards Olney And the said Commissioners do hereby order direct and award that all the Grass and Herbage growing arising and ??ronowing?? in and upon all the said publick Bridle Ways Publick Footways and private Carriage and Drift Roads shall at all times for ever thereafter be enjoyed had and taken by the respective Proprietors Owners and Occupiers of the several Allotments through which the said publick bridleways public footways and private carriage and drift Roads are hereinbefore respectively directed to go or pass over to the exclusion of all other persons whomsoever And the said Commissioners do hereby award order direct and appoint that the said publick bridle ways and private Carriage and Drift Roads hereinbefore described shall after the same have been formed and made safe and convenient for the passage of horses cattle and Carriages in pursuance of the directions of the said Act to be maintained and for ever thereafter kept in repair together with proper Gates by and at the expense of the respective Owners and Proprietors for the time being of the several Allotments through which the same do resectively pass And the said Commissioners by virtue and in further pursuance of the directions of the said Act Do hereby set out allot and award One Plott piece or parcel of Land or Ground situate on Mortar Pitt Piece containing two Acres two Roods and thirtyone Perches as the same is now admeasured staked and set out exclusive of the private road hereby directed to pass over the same bounded on the North East and South East by the second Allotment hereinafter awarded to the said Samuel Greatheed and Ann his wife devised by the will of the said John Hamilton and in the South West and North West by an Allotment hereinafter awarded to the said John Walker which said Plott piece or parcel of Land or Ground shall be used in common by the Proprietors of Lands and Grounds in the Parish of Sherington aforesaid and their tenants as well for their own necessary uses as the repair of the public and private Roads in the said Parish And the said Commissioners do hereby set out allot and award Unto and For the said Alexander Cromleholme and his Successors Rectors of the Rectory of Sherington aforesaid in lieu of and for the Glebe Lands of the said Alexander Cromleholme as Rector as aforesaid in the Open and Common Fields of Sherington aforesaid and for the right of Common belonging to the said Rectory in over and upon the said Lands and Grounds by the said Act directed to be divided and inclosed the two several Plots pieces or parcels of Land next hereinafter particularly mentioned and described (??Videlicet??) One Plott piece of Land or Ground situate in Moon piece and Park Leys containing ten Acres three Roods and twentysix Perches as the same is now admeasured staked and set out bounded on the North East by the fourth described Road called the Chichley Road on the South East by the second Allotment hereinafter awarded to the said William Brooks for Land and Common Rights on part of the South West by the second Allotment hereinafter awarded to the said Thomas Battams for Land and Common Rights on part of the North West on other parts of the said South West and North West by old inclosures belonging to the said

Newport Pagnell Road The Hedges Ditches Mounds and Fences of which said last described Allotment on the East and North sides thereof shall be made and forever thereafter maintained and kept in repair by and at the expense of the said Master and Governors and the Owner or Owners of this Allotment for the time being and which said Allotments hereinbefore severally awarded to the said Sir John Buchanan Riddell William Praed Dryden Smith the Wardens and Commonalty of the said Company of Mercers Charles Chester Samuel Greatheed George Pitt Hurst Samuel Boddington John Clayton William Brooks Thomas Battams John and Richard Hale Thomas Odell John Walker Jane Sutcliffe William Field William Davison Thomas Meacher John Woodward Marianne and Charlotte Hosea Thomas Tandy the said Churchwardens and the said Master and Governors of Queen Anne Hospital are in the judgement of the said Commissioners a full compensation for and are directed by the said Act to be severally held and enjoyed in bar of and on a full satisfaction and compensation for the pieces or parcels of Land and Ground as well as the Right of Common and other Rights and Interests in over and upon or in respect of the said Lands and Grounds within the said open and Common Field called Sherington Field in the Parish of Sherington aforesaid And as to for and concerning the charges and Expenses incident to and attending the soliciting obtaining and passing the said Act and all other the costs charges and expenses attending the execution of the same and the costs and charges of surveying and admeasuring dividing and allotting the said Lands and Grounds so directed to be divided and inclosed as aforesaid And of forming and putting into repair the publick Roads ?agreeable? to the directions of the said Act And also of the preparing and inrolling this Award and the charges and expenses of the said Commissioners and of the several persons employed by them in and about the said Division and Inclosure and all other necessary charges and expenses in about and concerning the same The said Commissioners have drawn up and stated a particular Amount thereof and of the several Sums of Money received of the said proprietors respectively and have caused an Entry thereof to be made in their Book and have signed the same In Witness whereof the parties first above named have hereunto set their Hands and Seals the Fourth Day of July in the year of our Lord One thousand seven hundred and Ninety seven
